Vacation and Sick Leave in Jamaica: What You Are Actually Entitled To

Leave entitlements in Jamaica are governed by the Holidays with Pay Act and the Holidays with Pay Order, 1973. The rules are more specific than most employees realise, and the accrual thresholds catch people out.

Vacation leave

The framework works on days actually worked in a qualifying year, not on calendar months employed.

So a new employee is not entitled to paid vacation immediately. The 110-day threshold has to be crossed first, and entitlement is typically taken in the year following the qualifying year unless agreed otherwise.

Many Jamaican employers are more generous than the statutory minimum — three weeks after five years is common practice rather than law. Check your contract, because a better contractual term applies over the statutory floor.

You should be paid your normal wage for leave, and payment should generally be made before the leave begins.

Sick leave

Sick leave operates under the same Order and accrues on a similar basis.

  • Entitlement begins after 110 days of work.
  • Between 110 and 220 days, you accrue one day per 22 days worked.
  • After 220 days, the full entitlement of ten days (two weeks) per year applies.
  • Employees with ten or more years of continuous service are generally eligible for three weeks.

Notify your employer on the first day of absence. A medical certificate from a registered practitioner is generally required where absence exceeds a few days — commonly stated as more than two or three days, so check your handbook.

An employer may not be required to pay sick leave where you are entitled to a benefit under the National Insurance Act or the Workmen’s Compensation Act, or where you failed to notify them.

The crucial difference at separation

This catches people out constantly:

  • Unused vacation leave is payable when you leave, whether you resign or are terminated.
  • Unused sick leave is generally not payable.

Check your final payment includes accrued vacation. If it does not, query it in writing.

Unused vacation does not automatically roll over year to year — your contract determines what carries forward, so find out rather than assuming.

Public holidays

Jamaica observes ten public holidays: New Year’s Day, Ash Wednesday, Good Friday, Easter Monday, Labour Day (23 May), Emancipation Day (1 August), Independence Day (6 August), National Heroes Day (third Monday in October), Christmas Day and Boxing Day.

These are guaranteed paid days off. Where a holiday falls on a Sunday it is generally observed on the Monday.

If you are required to work a public holiday, you are entitled to double the base rate, or a paid day off in lieu. At the current minimum wage that is $850 per hour.

Other leave

Maternity leave: twelve weeks for qualifying employees, first eight paid. Requires 52 weeks of continuous employment and written notice by the 29th week of pregnancy.

Paternity leave: no general statutory entitlement in the private sector. Some employers provide it contractually and specific arrangements exist in parts of the public sector.

Compassionate leave: not a statutory entitlement, but commonly provided by employers — frequently around three days. Check your handbook.

Practical points

  • Track your own leave balance. Payroll errors happen and nobody else is checking on your behalf.
  • Request leave in writing and keep the approval.
  • Ask about carry-over rules before the year ends rather than after.
  • Casual and seasonal workers have different treatment under the Order — ask specifically if that describes you.
  • If your employer refuses statutory leave, or does not pay accrued vacation on separation, the Ministry of Labour and Social Security can advise.
