Probation Periods in Jamaica: Your Rights and the 90-Day Rule

Probation is widely misunderstood in Jamaica, in both directions. Some employees think they have no rights at all. Some employers think probation is a period where normal rules do not apply. Neither is quite right.
Probation is not legally required
Jamaican law contains no mandatory probationary period and sets no statutory maximum length. Probation exists only if your contract or a collective agreement says so.
Where it is used, three to six months is typical, and collective agreements in some industries specify their own terms.
The 90-day rule
This is the part worth understanding precisely.

So a six-month probation does not mean six months without notice rights. The 90-day threshold is what governs, regardless of how long the stated probation runs.
Separately, notice of dismissal is generally required for employees continuously employed for at least four weeks.
What you keep during probation
Probation reduces notice protection. It does not suspend everything else:
- Minimum wage applies from day one — currently $17,000 per 40-hour week.
- Statutory deductions — NIS, NHT, education tax and PAYE where applicable — apply from your first payslip.
- Overtime rates apply.
- Workplace safety obligations apply.
- NIS coverage, including employment injury benefit, applies.
- Leave begins accruing toward the qualifying thresholds, even if you cannot take it yet.
Legal commentary is clear that probation does not remove all employee rights, and that documenting concerns and giving an employee a chance to respond remains best practice even during probation.
What probation does not cover
Redundancy payment requires 104 weeks of continuous employment, so probationary employees will not qualify.
Maternity leave requires 52 weeks of continuous employment with the same employer.
Paid vacation and sick leave generally begin qualifying after 110 days of work.
Making probation work for you
- Get the terms in writing — length, review dates, criteria.
- Ask what success looks like in the first week rather than discovering at the review that expectations differed.
- Request interim feedback rather than waiting for a single verdict.
- Keep your own record of what you have achieved.
- Confirm confirmation in writing. Many employers let probation lapse without saying anything — ask for a letter.
If probation is extended
Extension is not automatically unfair, but you are entitled to know why, what needs to change, and by when. Get it in writing.
An indefinite or repeatedly extended probation is a signal worth reading — either about the employer’s intentions or about their management.
If you are dismissed during probation
You should still receive outstanding wages and any accrued entitlements. If you are past 90 days, notice or pay in lieu applies.
Dismissal during probation is harder to challenge than dismissal afterwards, but the manner still matters. If you believe it was for a discriminatory reason, or the process was conducted in bad faith, the Ministry of Labour and Social Security can advise.
